FirstAidTag is NOT an emergency response service. We do NOT dispatch ambulances, police, or emergency services. Our service displays medical information when your bracelet is scanned and alerts your emergency contacts.

Do not rely on FirstAidTag for emergency response.

1. Acceptance of Terms

By accessing or using FirstAidTag services (the “Service”), including our website, mobile application, and wearable medical ID bracelet, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

Minors: If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian.

3. Not Emergency Services

FirstAidTag is NOT a substitute for emergency medical services or 911.

  • • We do NOT dispatch emergency services
  • • We do NOT provide medical advice or emergency response

Do not rely solely on FirstAidTag for emergency response. SMS and app notifications may be delayed, fail to deliver, or be unavailable due to:

Network outages
Device issues
Carrier problems
Technical failures

4. User Responsibilities

You Are Responsible For:

Accurate Information

  • • Providing truthful, current, and complete medical information
  • • Updating your profile when medical conditions change
  • • Ensuring emergency contact information is current

Device Maintenance

  • • Keeping your mobile device charged and operational
  • • Maintaining active cellular service
  • • Installing app updates promptly
  • • Replacing worn or damaged bracelets

Emergency Contacts

  • • Obtaining consent from emergency contacts before adding them
  • • Ensuring contacts understand they may receive alerts
  • • Updating contacts if phone numbers change

Security

  • • Protecting your account password
  • • Not sharing account access with unauthorized persons
  • • Notifying us immediately of any unauthorized use

5. Medical Information Accuracy

You acknowledge that:

  • Medical information displayed is what YOU provided
  • We do not verify medical information accuracy
  • We are not responsible for errors in your medical profile
  • Outdated or incorrect information could affect emergency response

You agree to:

  • • Review and update your medical information regularly
  • • Ensure information is accurate to the best of your knowledge
  • • Accept responsibility for any consequences of inaccurate information

6. SMS Messaging Terms

By providing your phone number, you expressly consent to receive SMS messages including:

QR code scan notifications
Account security codes (OTPs)

10. Account Termination

We disclaim all warranties including:

13. Limitation of Liability

Maximum Liability

Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim, or $100, whichever is less.

Excluded Damages

We are not liable for indirect, incidental, consequential, or punitive damages.

14. Indemnification

You agree to indemnify and hold us harmless from any claims arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Inaccurate information in your medical profile
  • Actions of your emergency contacts

15. Dispute Resolution

Class Action Waiver:

You agree to resolve disputes individually, not as part of a class action.

Continued use after changes constitutes acceptance.

No Waiver

Our failure to enforce any right does not waive that right.

Assignment
